Man Arrested on Suspicion of Attempted Murder

The incident on Wednesday night involved two brothers inside an Albany residence.

Albany police have arrested a man on suspicion of attempted homicide in connection with a gun incident on Wednesday night

According to an Albany Police Department press release, police received a report Thursday, Jan. 24, about 2 p.m. of an altercation between two adult brothers which occurred inside an Albany home the previous night.

During the dispute, one of the men reportedly held a loaded handgun to the head of the other and pulled the trigger while menacing the victim, police said.

After an investigation into the incident, Albany police arrested John Delaney, 48, during a vehicle stop on the 900 block of Jackson Street in Albany, shortly after 6 p.m. Thursday, police said.

The handgun involved was recovered and is in police evidence, according to the press release.

"Delaney was transferred to the custody of the Alameda County Sheriff’s Department, where he is being held without bail on charges of attempted homicide," police said.

He is scheduled to be arraigned on Jan. 28, according to the press release.

Hi Drennen, as the post states, police arrested the suspect on Jackson St. However, APD is not releasing the address where the fight happened because it's the residence of the victim.

You say the gun was loaded, and at the victim's head. However, you are not saying he's dead. What happened? Did the gun misfire?

Robert, there are a number of ways a loaded gun might not fire when the trigger is pulled. A revolver could have the next chamber empty but still be loaded, a loaded automatic needs to have the first bullet chambered before it fires. I think this is a good example of how personal gun ownership makes us less safe. Brothers fight, but without a firearm involved it rarely gets to the level of an attempted murder charge.

I just heard about this from another neighbor on Jackson (I'm one street over and just on the other side on Cerrito). Very distressing and frightening. I don't think the article is overdramatizing, after talking to my neighbor: 5 police cars, the accused in the middle of the street with at least one officer holding a gun on him: creepy for Albany. At least, Albany this far from San Pablo.

Truly sad stuff. This is a family issue, and i'm sure there is not one person reading this article who hasn't had an issue in their own family that wasn't one bad decision from being out of control. How about showing some compassion or even support for a family that needs it right now? I moved to Albany for it's small town environment and conscientious citizenry and this is a perfect opportunity for all of us to join together in support of our neighbors instead of passing judgement. I wish the Delaney family strength and comfort in this time of need.

And the holier than tho Ablany- ites that do NOT know the family need to quit the gossip and mind their own business. How about showing some support for a family that needs it right now. Like I said get a LIFE. There are more facts than what you read in the newspaper. How about a prayer instead....................

John Delaney is no longer being charged with attempted murder, it was lowered to assault with a deadly weapon. Please give all of the facts of a story which so greatly impacts many people.
